Is the town liable, Should i get a lawyer, Or should I just give up?

I was parked on the road at my moms house one night to help her take care of my grandmother. We had a huge storm that night and a tree limb fell and hit my car. The tree was on town property. The damage was a dented hood, side panels, and shatters windshield. My mom called the town and reported the damage to my car. The town stated "If the tree is not diseased then we are not responsible." The town sent out some tree experts, and they found it was diseased. Not only the tree that hit me, but the three in the area were all diseased. They told me to take as many pictures as possible and get 2 quotes for repair. I did both. They sent the information to the towns insurance who called me and said "The town was not aware these tree's were diseased so its not their responsibility." Should I get a lawyer, or is it not worth fighting over $2000.
